Terms and Conditions

Article 1. Definitions

In these terms and conditions, the following definitions apply:

- Black & White Fitness: the operator of the sports facility at Takkebijsters 2, 4817 BL Breda.

- Member: the natural person who has entered into a membership agreement with Black & White Fitness.

- Membership agreement: the agreement under which a member has access to the facilities of Black & White Fitness.

Article 2. Membership and payment

2.1 A membership starts on the date of registration, unless otherwise agreed in writing.

2.2 The membership fee must be paid monthly in advance by direct debit, unless otherwise agreed.

2.3 In the event of late payment, Black & White Fitness reserves the right to refuse access to the facility until all amounts owed have been paid in full.

2.4 Price changes will be announced in writing or by email at least 30 days in advance.

Article 3. Cancellation

3.1 A monthly membership can be cancelled on a monthly basis, with a notice period of one calendar month.

3.2 Notice of cancellation must be given in writing or by email (receptie@blackandwhitebreda.nl).

3.3 An annual membership has a minimum term of 12 months and can be cancelled monthly thereafter.

Article 4. Freezing your membership

4.1 In the event of demonstrable illness, injury or pregnancy, the membership can be temporarily frozen. To do so, a written request must be submitted to reception.

4.2 A membership can be frozen for a minimum of 1 month and a maximum of 3 months per year.

Article 5. House rules and conduct

5.1 Members must follow the instructions of Black & White Fitness staff.

5.2 Members are required to wear clean sports shoes and use a towel when using the equipment.

5.3 In the event of serious misconduct or violation of the house rules, Black & White Fitness reserves the right to refuse members access or to terminate their membership with immediate effect, without any refund of membership fees.

Article 6. Liability

6.1 Black & White Fitness accepts no liability for injury, theft, or loss of or damage to the property of members or visitors, unless this is due to intent or gross negligence on the part of Black & White Fitness.

6.2 Participation in classes and use of the facilities are at the member's own risk.

Article 7. Complaints

Complaints about the services of Black & White Fitness can be submitted in writing to the management via receptie@blackandwhitebreda.nl. Complaints will be dealt with within 14 working days.

Article 8. Governing law

All agreements between Black & White Fitness and its members are governed by Dutch law. Disputes will be submitted to the competent court in the district of Zeeland-West-Brabant.
